What is a contingent fee?

 

It is consdiered a contingent fee when the fee is based on some factor other than a set cost. This is as opposed to an hourly billing rate or a flat fee. In the case of certified class action lawsuits, contingent fees paid to the plaintiffs’ attorneys are always approved by the court and calculated as part of the final settlement.

 

At Michael P. Malakoff, all of our fees are contingent on the settlement of the cases we handle. There is never any up-front or out-of pocket expense for any client.
